REGULATION OF OPERATION

Article 1

Definitions and power limits of the regulation of operation

 

1.1           For the purposes of this Regulation, the terms used have the following meanings: –

1.1.1       Boatyard for Sailing & Motor vessels of Partheni, Leros: Boatyard with all necessary facilities & equipment for lifting and storing the Vessels ashore.

1.1.2       Company/business: “NAVMARE BUSINESS DEVELOPMENT & CONSULTING LTD” and allied companies as the operational entities of the Boatyard for drying/wintering of vessels at Partheni, and the Tourist Anchorage of Lakki (Lakki Marina), Leros.

1.1.3       Land area, defined by the approved topographic coastline chart under the Ministerial decision published in Government gazette n. 1116/31-12-1998.

1.1.4       Land area for drying/wintering: The Company’s property of land area, properly constructed for laying up/immobility, wintering/drying of vessels/boats, recreational crafts under the Boatyard and lifting basin license 2111.3/03/2002 issued by the Ministry Merchant Marine, Coast Guard Headquarters, Port Authority of Leros.

1.1.5       Recreational vessel: As defined in Law 2743/99.

1.1.6       Skipper/captain/crew/persons on board: As defined in § 1 of the Law 2743/99.

1.2           This Regulation was drawn up on in accordance with what is provided by the General Regulation of Operation of Tourist Ports, no. T/9803, Government Gazette B’ 1323/16-09-03 and governs the Tourist Anchorage of Lakki (Lakki Marina), Leros that was surveyed under the provisions of Article 30, par. 5, and Article 41 Annex II of L.2160/93. The Tourist Anchorage of Lakki (Lakki Marina), Leros, includes all kinds of works and facilities sited within this area, under the Min. Decision 1747/23-4-1997.

1.3           The Regulation of Operation governs both the Boatyard (land area) and sea area under the jurisdiction of the operating body and to all kinds of vessels and boats located therein. All parties who make use of the premises, facilities, and the land/ sea areas in general, either granted or owned, which is under the jurisdiction of The Company, are subject to the provisions of this Regulation. Any kind of traders or people circulating in areas of the premises, as listed, and defined in this Regulation, shall unconditionally comply with the instructions and orders of the competent bodies and the Service staff of the body/company as this is meant and described in this Regulation. Anyone using The Company’s services and facilities of the operating body of The Company must follow the rules and conditions set out below.

1.3.1       The current General Regulation of Operation of Tourist Ports.

1.3.2       This Regulation of Operation.

1.3.3       The application/contract of wintering or berthing & other services signed during the wintering or mooring of the respective vessel at the Boatyard of Partheni or the Tourist Anchorage of Lakki (Lakki Marina).

1.3.4       The contract or cooperation agreement which the Boatyard of Partheni and the managing body of Tourist Anchorage of Lakki (Lakki Marina), namely The Company, has concluded with one or more other companies representing or brokering ship-owners of recreational vessels who have common or similar objectives with the operator.

1.3.5       Other regulations and instructions issued by each Directorate of the Operating Body.

1.4           The current provisions and special Regulations of the Port and Customs authorities on the control of the port area and the docked or moving vessels/boats/yachts at them, also apply to the Operator’s control zones, and to the control zones of The Company, in general.

Entrance coordinates:

1.4.1     Lifting basin of the Boatyard of Partheni, Leros: 37 11′ 23” B – 26 48′ 27” A.

The approach area to the Lifting basin is a minimum of 50,00 meters in width with North – Northeast direction. The maximum draft is 14,00 meters, and the minimum is 5,50 meters at the front side of the Lifting basin, while the average draft at the approach area is 7,50 meters. The maximum length of the Lifting basin is 25,00 meters while the maximum width is 6,60 meters and its draft 5,00 meters.

1.4.2     Tourist Anchorage of Lakki (Lakki Marina), Leros: 37 07′ 80” B – 26 50′ 90” A.

Entrance of Tourist Anchorage (Lakki Marina):

Entrance width of 80,00 meters with East – Southeast direction. Minimum entrance draft of 11,00 meters, minimum draft right in front of the piers of 4,50 meters, and an average minimum draft of the quay of 8,00 meters.

Appendix A.

Boatyard site plan specifies the limits of the land area and the lifting basin of Partheni, which consists of 380 m2 of the sea and 60,000 m2 of land area.

Tourist Anchorage of Lakki (Lakki Marina) site plan specifies the limits, consisting of 6,600 m2 of the sea and 630 m2 of land area.

Appendix B.

It refers to the size (minimum and maximum), the number per unit, and category of the vessel, as well as to the total number of boats that can haul up for drying/wintering/repairs at the land area – boatyard owned by The Company at Partheni, Leros.

Appendix C.

2.1.        The Company’s structure and organization chart is described below.

2.1.1.      The Company’s Board of Directors, through the CEO, establishes the framework of operation and organization of The Company, approves any changes – proposals on the regulation of operation of the Boatyard & the Tourist Anchorage (Lakki Marina) based on proposals prepared and proposed by the CEO.

The Company’s organizational structure’s administrative levels are Directorate-General – Directorate – Department – Office – Workshop. The respective operators of these administrative levels are called Managing Director (CEO) – Director – Department Manager – Office Manager – Technical Manager.

 

Article 3

Hauling – launching – storage of vessels & technical support.

 

3.1  The Company, operator of the Boatyard of Partheni and the Tourist Anchorage of Lakki (Lakki Marina), disposes of land space for the wintering of recreational vessels, while providing services of technical support, maintenance, and repair of the vessels and their equipment, the Company also has the necessary means for hauling and launching said vessels.

3.2  Hauling-launching and storing boats ashore with a Marine Hoist shall be performed only after receiving specific written authorization from The Company’s competent traffic office and by the authorized personnel of the Directorate. For the haul out or launch in a vessel, the following procedure is required:

3.2.1       The owner, skipper, or representative of the vessel shall previously fill in the application form, which shall be accepted in written form by the Directorate of The Company.

3.2.2       The provision of a copy of an active full coverage insurance policy.

3.2.3       The payment of hauling – launching, and storage fees.

3.2.4       The unconditional acceptance on behalf of the owner, skipper, or representative of the vessel of the General regulation of operation of Tourist Ports, the Regulation of Operation of the Boatyard, and the Tourist Anchorage of Lakki (Lakki Marina), as well as of general or specific regulations issued by the Directorate of The Company.

3.3  Applications for hauling-launching and staying of vessels on land shall be approved by the Company’s competent traffic office based on priority and always according to the planning and operational needs of The Company.

3.4  Cleaning the hull via water blasting or any other way is prohibited from taking place outside the space designated for this work. This work is performed solely by The Company’s qualified personnel.

3.5  The vessel owner is obliged to observe the following concerning the hauling-launching of the vessel: –

3.5.1       To move the boat to the basin upon the receipt of such command and remove it immediately after launching.

3.5.2       To ensure the safe stay of the vessel in the basin and to secure and maintain its parallel position in relation to the two sides of the basin until it is hauled.

3.5.3       To make sure, to disconnect and stabilize or remove the equipment of the vessel which can pose a problem to the safe hauling-launching of the vessel, its safe transfer or secure support, i.e., fore stay, shroud, rigging, stainless steel or steel structures, antennas, and other protruding parts.

3.5.4       To indicate the exact point of lifting straps on the travel lift to haul the vessel, as well as the points of support for the deposition on the cradles. The owner is also obliged to provide in writing and in advance any technical or other information and peculiarity for safely hauling, moving, supporting, and launching the vessel.

3.5.5       To hire a diver, in case his/her presence is required, for the correct and safe positioning of the suspension straps at the hull(s) of the vessel.

3.5.6       To inspect and confirm the safe hauling, supporting, and launching of the vessel.

3.5.7       To be present during the hauling – launching process of the vessel and to take the requisite action as specified in this Regulation for safely lifting or moving the vessel. The hauling, launching, or transfer of the vessel without the owner’s presence is permitted in exceptional cases only, if a representative is provided with authorization by the owner, whereby he/she assumes all responsibilities. If the presence of the owner or representative is impossible, the hauling or launching, or movement of the vessel, if needed, takes place without their presence but with the sole responsibility of the owner.

3.6  After hauling, depositing, and stabilizing the vessel on the mounting bases ashore, it is prohibited in any way and for any reason to the owner, to perform any operation to the support system, and any such operation is performed solely by The Company’s authorized staff and only on the Technical Director’s order.

3.7  The Technical Directorate shall set the vessel’s storage location ashore and is the only one that has the right to move the vessel to another location, if necessary, for the safety and proper functioning of the land area. The owner or representative shall be present when moving the vessel, but in case of inability to attend, then the transfer is performed by The Company’s authorized personnel with the sole responsibility of the owner.

3.8  During the stay of vessels on land, engine operation is not allowed, as well as the use of sails and climbing the mast of the boat. The owner of a sailing vessel shall explicitly remove the sails of his/her vessel before hauling it and reinsert them after launching.

3.9  Accommodation and overnight stay of the owner or crew on board when ashore, is permitted only after written approval by The Company and a written declaration shall be signed by the owner and crew by which they assume full and sole responsibility for any accident/s that can happen to him and his crew as well as for losses, damages or accidents that may be caused by him/them to third parties.

3.10        The owner of the vessel which takes up space in the land area, is responsible for the cleanliness and orderliness of this space. If the owner does not comply with the cleanliness rules, then the management of The Company order the cleaning of the area and charges the relative costs to the ship-owner.

3.11        It is expressly forbidden to the owner or other person to intervene to the equipment and facilities of land area, for any repair or improvement thereof. The owner is obliged to report any damage to the Management, which will cater to restore it using its authorized, for this work, technical personnel.

3.12        Vessels on a trailer or small auxiliary boats, or trailers are not allowed at the land area without permission by the Management, and without paying the agreed price for staying.

3.13        Passing cars and vehicles in general are not allowed at the land area of vessel storage, and permission is only granted to vehicles for certain actions, like handling objects. Special permission for car parking is required by The Company’s Management, which is always a predetermined place and for a predetermined time.

3.14        No entry, stay and performance of work is allowed on board of the vessels when ashore, by unauthorized personnel or other persons. Authorized personnel remain in the land area where vessels are stored and performs operations on them only during the hours designated by the management of The Company.

3.15        For any action concerning cleanliness or small-scale maintenance, which the ship-owner wants to perform himself, prior written request, stating these small-scale operations and the time within which they will be performed, is required for authorization by the Management. The Management of The Company may refuse permission if it considers these small-scale operations that the owner wants to perform is harmful and/or dangerous. In each case, written authorization by the Management is required before starting any work of any scale.

3.16        Persons other than the staff and The Company’s partners are not allowed to perform work, repairs, or maintenance on vessels. The management of The Company may refuse to carry out maintenance and repair work to people who do not belong to its staff, as long as the work is performed at the premises and facilities thereof.

3.17        Sanding tasks and the hull painting and the polishing of the freeboard of the vessels, are only carried out by The Company’s authorized personnel, unless the owner himself wants to execute them, with his own responsibility and always under the condition of receiving an authorization from the Management of The Company.

 

Article 4

Conditions for berths appointment & arrival – departure procedure.

 

4.1           Conditions for berths appointment

4.1.1       Recreational vessels whose overall length does not exceed 60,00 meters and draft 6,00 meters can berth, moor and use the tourist facilities of the Tourist Anchorage of Lakki (Lakki Marina).

4.1.2       Mooring rights are acquired at the request of the owner, captain, or legal representative of the vessel.

4.1.3       Basic condition for mooring is the unconditional and without reservations acceptance on behalf of the captain, owner, or legal representative of the vessel, of the regulation of operation of the Tourist Anchorage of Lakki (Lakki Marina), as well as of other regulations of The Company, including general and special Decisions of the Management and finally the signing of the relevant agreement.

4.1.4       Moored vessels must be equipped with the necessary declaratory documents in accordance with applicable laws, either Greek or of the corresponding authorities in the event they are foreign flagged.

4.1.5       Moored vessels must be equipped with the legally valid seaworthiness certificates. If a certificate of seaworthiness has expired, it should be reported directly to the Directorate of the Tourist Anchorage of Lakki (Lakki Marina).

4.1.6       Moored vessels must be insured according to Greek legislation (Law. 2743/99).

 

4.2    Arrival – departure procedure

4.2.1       The skipper shall inform the vessel traffic office of the Anchorage before entering about the precise time of their arrival, the characteristics of the vessel (length, width, draft) as well as about the period of time of their stay.

4.2.2       Before reaching the sea area of the Tourist Anchorage of Lakki (Lakki Marina), the skipper is obliged to contact the traffic office of the Tourist Anchorage via the VHF in the specified channel 11 or 72.

4.2.3       The maximum speed of vessels within the sea area of the Tourist Anchorage should not in any event exceed 3 knots.

4.2.4       Right upon arrival, the skippers of the vessels must necessarily fill in the forms delivered to them, hand over the documents requested by them and notify of any problems, injuries, or damage.

4.2.5       The vessel traffic office of the Tourist Anchorage of Lakki (Lakki Marina) has the jurisdiction to indicate the berth for any vessel approaching, and the skipper shall comply with the instructions given to them.

4.2.6       The skippers of vessels upon entrance – exit from the sea area of the tourist Anchorage of Lakki (Lakki Marina) shall:

4.2.6.1   Sail calmly if the weather and handling capabilities of the vessel permit so.

4.2.6.2   Strictly adhere to the provisions of the International Regulations for preventing collisions and rules of safe navigation.

4.2.6.3   Follow the instructions of the personnel of the Tourist Anchorage of Lakki (Lakki Marina) for safely mooring their vessels.

4.2.6.4   The formalities in force for the traffic of Tourist ships/boats, yachts, and recreational vessels in general in all ports servicing yachts of Greece, are also in force at the Tourist Anchorage of Lakki (Lakki Marina), like the sailing license, the crew and passengers’ lists, confirmation of shipping documents, etc. as the current law requires.

4.2.6.5   The Anchorage of Lakki (Lakki Marina) may refuse to berth vessels which are not seaworthy or that have a problem that could endanger people, other vessels, or the Anchorage itself.

4.2.6.6   Dropping an anchor is prohibited and is exceptionally permitted only at the suggestion of the Anchorage’s personnel. In General, the dropping of anchors, attachment to permanent berths, stern berthing, alongside berthing, etc. shall only be performed following the instructions of the Anchorage’s personnel and always at the responsibility of the skipper of the vessel.

4.2.6.7   Availability of premises is in accordance with the discreet will of the vessel traffic office, which may change positions of docked vessels, according to the needs of the Tourist Anchorage of Lakki (Lakki Marina).

4.2.6.8   Anchoring at will, stern berthing and alongside berthing of any vessel, as well as the occupancy of any berth, except for the one indicated by the traffic office and the personnel in charge, is prohibited.

4.2.6.9   Obstruction, in any way, of the navigation and entrance channel of the Tourist Anchorage of Lakki (Lakki Marina) is prohibited.

 

 

 

Article 5

Mooring & Staying of vessels at the Tourist Anchorage of Lakki (Lakki Marina).

 

5.1  For berthing a vessel and staying at the Tourist Anchorage of Lakki (Lakki Marina), the approval of the relevant Department is required, as well as the payment of the corresponding fee.

5.2  All vessels during their stay, must be equipped with all necessary life vests, safety and extinguishing equipment, and any other instruments, devices, etc. required by the relevant regulations and provisions.

5.3  The traffic office shall be informed prior to departure, for the scheduled date of departure/exit and return/arrival of the vessel, otherwise it is considered that the vessel permanently departs.

5.4  In the case of absence from its position of a vessel permanently moored at the Tourist Anchorage of Lakki (Lakki Marina), the competent office has the right to dock a different vessel in its place, as desired.

5.5  The vessels’ crew, passengers, persons on board and visitors shall be reported by the skipper of the vessel to the traffic office of the Tourist Anchorage of Lakki (Lakki Marina) and comply with the regulations, the general and special instructions of the administration and the suggestions made by the Tourist Anchorage of Lakki (Lakki Marina) personnel.

5.6  If the owner or skipper of the vessel, is absent for a period beyond 24 hours and up to 72 hours, shall inform the traffic office and appoint a local representative, competent and responsible for the vessel, professional, who will have the approval of the directorate of the Tourist Anchorage of Lakki (Lakki Marina).

4.6.1       If the vessel remains without an owner or skipper for more than 72 hours, then the vessel will be transferred to the Boatyard of Partheni for storage and will return to the Tourist Anchorage of Lakki 24 hours before the arrival of the owner or skipper.

5.7  It is prohibited to make noise that may disturb the peace and quiet of those using the Tourist Anchorage of Lakki. Daily cleaning and maintenance of vessels, as well as minor repairs within the vessels may take place only between 08:00-14:00 and 17:30-20:00 every day and after having taken all necessary environmental precautions.

5.8  The unnecessary use of engines and generator sets during the stay of vessels at the Tourist Anchorage of Lakki is prohibited. Charging the batteries of vessels by turning on their engines is permitted between 09:00-11:00 and 18:00-20:00 every day.

5.9  Intervening or repairing the facilities of the Tourist Anchorage of Lakki (Lakki Marina) by technicians or others not set by the Management of The Company for this specific work, is prohibited.

 

Article 6

Services & amenities

 

6.1  The Company, provides all services concerning technical support, supplies, hauling, launching and repair of vessels, as well as other support services. Work is performed with care by the staff, during the operating hours, of course, and the following services are provided:

6.1.1       Permanent anchorages.

6.1.2       Dinghy.

6.1.3       Wireless communication via a VHF device.

6.1.4       Electricity and water supply at all times.

6.1.5       Internet connection via Wi-Fi at all times.

6.1.6       Pickup & Delivery of Mail.

6.1.7       Use of washing machines and dryers.

6.1.8       Receipt of waste oils, used batteries, organic waste and household waste.

6.1.9       Use of common toilets (WC and shower) at all times.

6.1.10    Fire Extinguishers & Life-saving equipment.

6.1.11    Antipollution equipment.

6.1.12    Supply ships with fuel at a predetermined position, where the preventive measures are increased and always at the presence of the personnel in charge at the Anchorage of Lakki, also requiring compliance with all specifications and safety and pollution rules for the sea and land area, as defined by the relevant national and international regulations and those laid down by the Directorate of the Anchorage.

6.2  Those interested, can be informed in detail about all services and their tariffs by the Management of The Company.

6.3  Connection and disconnection of the vessels to the special sockets (Pillars) is performed at the request of the owner and only by the authorized personnel of The Company.

6.4  Users of the operator’s premises, The Company, must make good use of said premises, always in accordance with the instructions of the competent departments, not cause any deterioration or damage and comply with the suggestions of the Anchorage’s personnel.

6.5  Docking/Mooring at berth, land space leasing and the use of services and facilities under the management/ownership of The Company, requires full knowledge and unconditional acceptance of the terms hereof, as well as of other regulations of The Company, general and specific Directives of the Management to all ship-owners, skippers, persons on board and visitors and tenants of vessels moored at the Tourist Anchorage of Lakki (Lakki Marina), who promise and guarantee compliance with the above, fully jointly and severally liable towards The Company and any third party.

6.6  Those people using the premises and facilities of The Company, land, and sea, are subject to the controls provided by the applicable Greek legislation, as well as the regulations issued by The Company management.

 

Article 7

Environment-Cleanliness-pollution-orderliness.

 

7.1  It is forbidden to throw away any material or object that causes or is likely to cause pollution of the sea or land areas.

7.2  It is forbidden to use chemicals and cleaning materials other than the approved ones by The Company’s management, which cover the required environmental standards.

7.3  Delivery of sewage and used oils is performed only after consultation with the traffic office. The delivery is performed by an authorized staff member of The Company, who will transfer them to suitable sealed tanks.

7.4  It is expressly forbidden to evacuate the vessel’s tank(s) in the sea area of both the tourist Anchorage of Lakki and sea area of the lifting/launching basin managed by The Company at Partheni, Leros as well as at a perimeter of three (3) nautical miles from them.

7.5  It is forbidden to throw away the sewage from the tanks of the vessels in the sea area of the lifting/launching basin managed by The Company at Partheni and the sea area of the Tourist Anchorage of Lakki (Lakki Marina), Leros as well as at a perimeter of three (3) nautical miles from them.

7.6  It is forbidden for vessels which have no sewage tanks and/or approved types of processing systems to use toilets in the sea area of the Tourist Anchorage of Lakki (Lakki Marina).

7.7  Disposal of waste is performed daily except Sundays in the morning from 8:00 am until 12:30 pm and only inside the specially placed bins, the waste is also to be packaged in eco-friendly type of bags. In case of a large volume of waste a consultation with the relevant department of The Company should precede.

7.8  It is forbidden to abandon any material or equipment at the premises of land area for the wintering of vessels at Partheni or the Tourist Anchorage of Lakki (Lakki Marina). The Company assumes no liability for damage or loss, otherwise the owner is charged for its removal from the relevant department.

7.9  Pollution in any way involves the unconditional coverage (compensation) of the decontamination costs and heavy fines, in accordance with the applicable special provisions.

7.10        The management of The Company, operating body of the Boatyard of Partheni and the Tourist Anchorage of Lakki (Lakki Marina), in collaboration with the Marine Environment Protection Bureau of the relevant port authority shall take all necessary precautions for the users of the Tourist Anchorage of Lakki (Lakki Marina) under L.743/77, L.1147/81 and Presidential Decree 55/98.

 

Article 8

Responsibilities.

 

8.1  Anyone who uses part of the land area of Partheni or part of the area of the Tourist Anchorage of Lakki (Lakki Marina) and any services provided by it and The Company facilities, namely port or land facilities and equipment, including mooring, piers or platforms and refueling points, for any reason, voluntarily or at the suggestion of the Directorate of The Company, acts on his responsibility.

8.2  The skipper and ship-owner, marine guests, and tenants agree that when mooring the vessel, they allow any law enforcement units, Customs, Police, port authority and security staff of The Company, to enter it whenever deemed necessary.

8.3  All moored/berthed vessels at the Tourist Anchorage of Lakki (Lakki Marina) must be seaworthy and ready to sail throughout their stay, under the responsibility of the owner or his/her representative.

8.4  The owner, his/her representative, or skipper of each vessel shall be responsible for any material or physical damage caused by the vessel to third parties or their belongings, premises, equipment, and port staff, as well as to other vessels located within the sea or land facility under the management/ownership of The Company.

8.5  The owner, his/her representative or skipper of each vessel must be able to show a valid insurance policy of the vessel of a reputable in Greece or the European Union insurance company, which should cover the minimum risks at the amount determined by current legislation (L.2743/99).

8.6  If the management of the Boatyard of Partheni and Tourist Anchorage of Lakki (Lakki Marina) deems as necessary, it may order any vessel to switch berth elsewhere in the boatyard or in Lakki Marina or even outside the boundaries of Lakki Marina. Indicatively switching berth is necessary for the following reasons:

8.6.1       If the boat is left unattended by the owner for a period exceeding three (3) days.

8.6.2       If, due to the vessel’s stay, the operation and utilization of the Tourist Anchorage of Lakki (Lakki Marina) is obstructed.

8.6.3       If there is a probability or risk of shipwreck, damage or pollution.

8.6.4       If there is an unauthorized berth/mooring at the Anchorage.

8.6.5       If the relevant department deems it necessary for the proper functioning of the Tourist Anchorage of Lakki (Lakki Marina).

8.6.6       If the owner does not meet the financial obligations to The Company, which arise from renting the land area for the wintering of the vessel at the land area of The Company or from the mooring fees to the Tourist Anchorage of Lakki (Lakki Marina).

8.7  In the event that one or more of the above conditions occur, it must be recorded by the Management of The Company, operating body of the Tourist Anchorage of Lakki (Lakki Marina), with involvement of the Head of the relevant Port Authority, who will define a deadline within a few days after being notified for the berth shifting of the vessel.

8.8  In the event of the third case, a three-day deadline is defined. The meeting minutes recorded are forwarded to the ship-owner, physical or legal entity, or captain-skipper or their legal representative or agent, and a copy of the record is sent to the relevant port authority. If the deadline expires and no action has been taken, the management of the Tourist Anchorage of Lakki (Lakki Marina) proceeds to switch berth of the vessel and certifies at the expense of the owner, any charges of berth switching. The ship-owner accepts that this certificate is enough to issue a payment order, which, when issued, is executed in priority to the detriment of the vessel.

8.9  In case of refusal for any reason and in any way, the assistance of the Port Authority is deemed mandatory (Repl. of Article only from 4514/26-26 Aug.1991 GG B’ 692, Ministry of Tourism, Economy, and Merchant Shipping).

8.10                 The Company, as operator of the Tourist Anchorage of Lakki (Lakki Marina), bears no responsibility for the storage of vessel which switched berth, or any damage incurred during the berth switching or stay in the new berth, at another anchorage or at anchor outside the zone of the Tourist Anchorage of Lakki (Lakki Marina).

8.11                 The skipper is required to ensure the safe mooring of the boat and to take all measures dictated by seamanship and experience within the framework of this Regulation and to respect the safety and property of others. The personnel of the Tourist Anchorage of Lakki (Lakki Marina) shall inspect the way the mooring of the vessel takes place and may make suggestions and take actions to better ensure the safety measures in emergency situations and shall charge the owner with any resulting costs.

8.12                 The presence of the service vessel and the recommendations of the staff of the land area of Partheni during the hauling process of the vessel or of the staff of the Tourist Anchorage of Lakki (Lakki Marina), does not exempt the skipper of any vessel of his/her responsibility, both for his/her handling of the vessel, and for mooring it on a permanent anchorage or handling of the stern fasts for binding to the pier or basin.

8.13                 Anyone aware of an event, action or situation that is or may become a risk for fire, explosion, threat to the safety of persons, or cause damage to the vessel or equipment, or pollute, he/she is obliged to immediately inform the management and staff of The Company.

8.14                 Whoever sees fire or explosion on a vessel or at the area of the tourist Anchorage of Lakki (Lakki Marina) is obliged:

8.14.1    To immediately notify in any way the fire department.

8.14.2    To immediately notify and report the incident to the management and staff of the Tourist Anchorage of Lakki (Lakki Marina).

8.14.3    To make use of the alarm systems that he/she or the base has, and of the safety systems in accordance with international regulations and the International Fire Alarm Code.

8.14.4    To take every possible measure to make use of the firefighting equipment of the Tourist Anchorage of Lakki (Lakki Marina) or of any vessel to minimize or extinguish the fire.

8.14.5    The staff of the Tourist Anchorage of Lakki (Lakki Marina) shall call the Fire Department, operate the firefighting mechanisms, and assist in the task of extinguishing the fire.

8.14.6    If the Port Authority or the relevant Department of The Company, operating body of the Tourist Anchorage of Lakki (Lakki Marina), order the berth switch of vessels, skippers must comply immediately with these instructions.

8.15                 The Management of The Company, operator of the Tourist Anchorage of Lakki (Lakki Marina), will report to the port authorities all those who remain at its premises and breach the terms of this Regulation.

8.16                 The Company, as owner of the land facilities of Partheni and as operator of the Tourist Anchorage of Lakki (Lakki Marina), Leros, bears no responsibility for any loss, damage, partial or total destruction of any asset of the owner, as well as for any injury to the crew or occupant of any hauled vessel, staying at the land area or docked/anchored vessel at the Tourist Anchorage of Lakki (Lakki Marina).

8.17                 The person responsible for the above is the owner or, in some cases, the skipper of the vessel, and the provided facilities and services to the vessel by the staff of The Company, operator of the Tourist Anchorage of Lakki (Lakki Marina), do not exempt them thereby of any responsibility.

8.18                 The Company, operator of the Tourist Anchorage of Lakki (Lakki Marina), bears absolutely no responsibility for compensation for any damage that can occur during berth/mooring at anchorage, or at vessels ashore due to unforeseen and random events due to unforeseen natural disasters and weather conditions.

8.19                 Customers of the Tourist Anchorage of Lakki (Lakki Marina) are not allowed to dispose the berth/mooring space of their vessel or vessels to third parties, not even temporarily, nor to change berth/mooring space between other vessels.

8.20                 In case the owner, when absent, decides to place a special guard at his/her unattended vessel, then the placement of said guard shall be notified to the management of The Company in order to be authorized.

8.21                 In the event of change to the ownership of any vessel, either deposited at the land area of The Company for drying/wintering or moored at the Tourist Anchorage of Lakki (Lakki Marina), then the seller must inform the management of The Company in writing on the effect of this change, certifying the name and permanent address of residence of the buyer, as well as the date of transfer. The buyer bears the same obligation. He/She, in any case, is to be jointly and completely liable along with the seller for paying off to The Company of the obligations of the previous owner of the vessel that he/she bought and now owns. The new owner, as long as he/she wishes for the vessel to stay at land or the sea area of The Company, must priorly obtain the approval from the Management of The Company, operator owner of the land area for the wintering of vessels at Partheni and of the Tourist Anchorage of Lakki (Lakki Marina), Leros.

 

Article 9

Rights & payments.

 

9.1  Every guest and vessel that makes use of the sea and land facilities and services of The Company The Company, acting as owner of the land facilities at Partheni and as owner of the land facilities at Partheni as the operating body of the Tourist Anchorage of Lakki (Lakki Marina), Leros, is charged the fees and other services in accordance with the tariffs in force. Guests and ship-owners of vessels unconditionally and unreservedly accept the applicable prices and payment conditions as stated in the respective published “Price List”.

9.2  Mooring/rental fees of vessels are to be paid upon arriving or hauling of the vessel and should suffice for the whole period agreed with the management of The Company.

9.2.1       As the first day for calculating the mooring or storage charges, we consider the day starting at 12:00, in which the vessel sailed into The Company facilities.

9.2.2       This provision applies in cases where the starting date for payment of fees was not agreed prior to arrival.

9.2.3       In the event of departure or abandonment of the berth before the time agreed for any reason, The Company/business is not obliged to return the prepaid fees or rents.

9.2.4       Vessels that are absent for one or more days from the Tourist Anchorage of Lakki (Lakki Marina) are also counted for the monthly or annual fee, so that these vessels can keep the right to use the premises of The Company.

9.3  Vessels using the facility for more than one month are required to pay the agreed fees/rents in advance within the first day of their arrival, unless there is another written agreement between them and The Company which provides for a different way of payment.

9.4  Transit vessels using the facility for less than one month are required to pay the fees in advance upon arrival.

9.5  In case of late payment of fees/charges beyond two months, then this automatically entails the loss of any right to use the vessel, giving the Management the right to remove it from both The Company’s control areas at the land area of Partheni and the Tourist Anchorage of Lakki (Lakki Marina), without any claim of the vessel owner to compensation.

9.6  Financial compensation of any kind concerning rents, water charges, telephone, electricity, service, repairs, maintenance, facilities, and all types of services are freely determined by The Company which maintains the right to change these prices without notice.

9.7  The following categories of vessels are exempted from payment of port charges.

9.7.1       Recreational crafts that resort to the Tourist Anchorage of Lakki due (Lakki Marina) to force majeure, making it dangerous for the craft to travel due to mechanical defects which ship-owners must register and request the assistance of the operator.

9.7.2       Patrol boats of the Coast Guard and Smuggling Department of the Ministry of Finance (one anchorage for each Service period).

9.8  If a vessel finds refuge at the Tourist Anchorage of Lakki due to mechanical failure and remains there for more than 24 hours, then it is required to pay fees, as calculated 24 hours after its arrival.

 

Article 10

Penalties

 

10.1                 Delay or non-payment of those fees and charges imposed by the management of the Tourist Anchorage of Lakki (Lakki Marina) to offenders, or of fees and charges relating to the land area of The Company, is in violation of the Port Regulations and entails fines and denial to the vessel or vessels of the debtor to exit the Anchorage, in accordance with the provisions of Law 499/1947 in conjunction with Art. 157 of the Code.

10.2                 Any serious repeated infringement or infringements of the Regulation of the Tourist Anchorage of Lakki (Lakki Marina) and its annexes, entail the removal of the vessel, and the imposition of penalties under the provisions of Law 499/47, in conjunction with Art. 157 of the Code.

10.3                 If the offender does not comply with the order to switch berth of their vessel or vessels outside or inside the Tourist Anchorage (Lakki Marina), in addition to being fined by the Port Authorities, the summary procedure of forced berth occupation is issued in accordance with the provisions of CL 499/1947 in conjunction with Art. 157 of the Code, while the Directorate of The Company after consultation with the Port Authority shall compulsorily switch berth of the vessel under the sole responsibility of the owner or skipper, or agent, or other representative. The costs of forced berth switching are borne solely by the offender/ship-owner.

 

Article 11

Radio Broadcasting

 

It is prohibited to visitors and ship-owners to broadcast radio and telephone signals for as long as they remain at the Tourist Anchorage of Lakki (Lakki Marina).

 

Article 12

Additional provisions

 

The approved regulations of The Company, the general and specific instructions issued by the Directorate which regulate all individual aspects as well as the applicable provisions and specific regulations of the Port, Customs and Police Authorities shall complementarily apply to this Regulation.
